Terms of Service

These Terms of Service govern your use of BOWLMINE (bowlmine.com), operated by GoveSoft s.r.o., Company ID (IČO): 29822726, with its registered office at Travinářská 1174, 756 61 Rožnov pod Radhoštěm, registered in the Commercial Register maintained by the Regional Court in Ostrava, file C 104672 ("we", "the operator").

What BOWLMINE Is

BOWLMINE is an information platform for the bowling community. It aggregates publicly available tournament and registration data from third-party sources. We are not a tournament organizer. The accuracy of aggregated data depends on the source systems.

Free and Paid Services

The core features (tournament calendar, bowling center catalog, player profile and social features) are free of charge.

User Accounts

You must provide accurate information when registering. You are responsible for keeping your credentials secure. We may suspend or terminate accounts that violate these terms.

Age of User and Protection of Minors

When registering, you provide your date of birth. Registration is permitted from the age of 13.

Users under 16 may use BOWLMINE exclusively with the consent and supervision of a parent or legal guardian (hereinafter "guardian"), who has accepted these Terms on their behalf and is responsible for their use of the service.

For users under 16, some features are restricted for privacy and safety reasons.

Providing a false date of birth (in particular to circumvent age restrictions) is a violation of these Terms and may result in account termination.

Content Rights and Consents

By uploading images or other content you represent that:

  1. Copyright — you are the author of the photographs or have permission from the author to publish them online to the extent necessary for BOWLMINE's operation. Copyright is protected by Act No. 121/2000 Coll. (the Copyright Act).

  2. Consents of depicted persons — persons depicted in the photographs have consented to the publication of their likeness in accordance with Section 84 et seq. of Act No. 89/2012 Coll. (the Civil Code). Distributing a person's likeness without their consent is unlawful.

  3. Protection of persons under 16 — if persons under 16 are depicted in photographs, you have the consent of their legal guardian to publish them. Publishing photographs of minors without such consent may constitute a criminal offence under Act No. 40/2009 Coll. (the Criminal Code).

By posting content you grant the operator of BOWLMINE a non-exclusive, royalty-free licence to display, store, and technically process it for the duration of your account or until you remove the content. Content published on behalf of a group, bowling center or tournament may remain published after your account is closed, without your name being shown.

Content Moderation and Violation of Terms

We reserve the right to remove without prior notice any content that:

  • violates these Terms,
  • violates applicable laws of the Czech Republic or the EU,
  • is manifestly offensive, discriminatory, or otherwise inappropriate,
  • has been reported by other users as problematic and we deem the report justified.

Criminal liability — content that may constitute a criminal offence will be hidden and, in cases required by law, reported to the competent authorities together with the information necessary for the investigation.

Repeated or serious violations of these Terms may result in suspension or termination of your account.

Groups

A group may be created and led (as owner or admin) only by a user who is at least 18 years old (we verify age from the date of birth entered in the account) and whose account is not blocked or restricted under moderation. A user may be a member of a group from the age of 16.

The owner and admins of a group (together, the "group leadership") set the group's rules and visibility, decide on membership requests, and may exclude posts and remove members within their group. Only the owner appoints and dismisses admins; the owner also decides who may post on behalf of the group and into the group. The group's rules must not conflict with these Terms, which always take precedence. Removing a member from the group is permanent; a return is possible only through BOWLMINE support. The group leadership cannot delete other people's posts or comments.

Decisions of the group leadership do not limit our right to act under the chapter "Content Moderation and Violation of Terms"; we may review, hide or dissolve a group and the posts in it independently of the group leadership.

A group may be dissolved by its owner or by us; members are notified of the dissolution. If you close your account as a group's owner, ownership passes to the longest-serving admin who meets the conditions for leading a group; if there is no such admin, the group ceases to exist and the content published on its behalf is deleted.

Special User Roles

Some BOWLMINE features are available only to users with an assigned special role. Users cannot assign the Tournament Organizer, Bowling Center Operator or Developer role to themselves: a logged-in user applies for it by submitting a request with a justification, and a BOWLMINE administrator decides on the request by approving or rejecting it. A request may be submitted only by a user who is at least 18 years old (we verify age from the date of birth entered in the account) and whose account is not blocked or restricted under moderation. Only one request may be submitted per role; a rejected request cannot be submitted again. There is no legal entitlement to being granted a role. We reserve the right to revoke roles at any time, in particular upon violation of the conditions below.

Tournament Organizer

A tournament organizer can create and manage tournaments, collect player registrations, and send automatic e-mail notifications via the BOWLMINE portal.

When using the portal, a tournament organizer must:

  • Process only data of players who have registered for the tournament — by entering player data into the system, the organizer confirms they have a legal basis for this processing (typically performance of contract — the player's registration for the tournament). Entering data of persons who have not requested participation is a violation of these Terms and of the GDPR.
  • Not use player data for other purposes — the organizer may not use personal data held in the BOWLMINE portal (name, e-mail) for marketing, forwarding to third parties, or any other purpose unrelated to managing the tournament in question, unless the player has given explicit consent (see registration form).
  • Send only tournament-relevant messages — automatic e-mail notifications serve exclusively to confirm registration, announce schedule changes, or process withdrawals from the tournament.
  • Provide accurate tournament information — the organizer is responsible for the correctness and currency of data. Publishing deliberately false information is a violation of these Terms.

Bowling Center Operator

A bowling center operator can add and manage bowling center records in the BOWLMINE catalog. The bowling center operator represents that they are the owner, employee, or otherwise authorised representative of the center and are entitled to publish information on its behalf. The same conditions apply to image uploads as for all users (see "Content Rights and Consents"). Adding or editing records of centers the bowling center operator is not authorised to manage is a violation of these Terms. The Bowling Center Operator role can also be obtained by verifying ownership of a bowling center: any logged-in user who meets the conditions above may apply to take over a bowling center even without having the role yet; the user obtains the role when a BOWLMINE administrator approves the submitted proof of ownership, or when the user confirms an e-mail address from the bowling center's domain.

Developer

A developer can register external data sources from which BOWLMINE imports tournament data. The developer confirms they own or have explicit permission from the source system owner for machine reading and data import into BOWLMINE. Registering sources in violation of the source system's terms (robots.txt, ToS) is a violation of these Terms. BOWLMINE may at any time, without prior notice, deactivate a source that violates these rules.

Limitation of Liability

BOWLMINE is provided "as is". We make no warranties regarding the accuracy or completeness of aggregated data. To the extent permitted by law, we are not liable for any damages arising from the use or inability to use the service.

Consumer Rights

If you are a consumer (an individual not acting in a business capacity), you may withdraw from a paid service contract within 14 days of purchase by sending an e-mail to info@bowlmine.com. Out-of-court dispute resolution is provided by the Czech Trade Inspection Authority (coi.cz).

Changes

We may update these terms. Material changes will be communicated by e-mail. Continued use after the effective date of a change constitutes acceptance.

Governing Law

These terms are governed by Czech law. If you are a consumer, this does not affect the rights granted to you by the mandatory laws of the country of your habitual residence, nor your right to bring proceedings before the courts of that country.
